The legal entity responsible for your personal data and therefore for the database in which they are located, is the CONFECCIÓN Y DISTRIBUCIONES FIRLÁN S.A.S. group, "BABALÚ", a company with its main domicile in the city of Medellín, Department of Antioquia, Republic of Colombia.

BABALÚ's services are not aimed at children and adolescents, so they are asked to refrain from contracting the product, service, registering for any BABALÚ interaction space, or requesting any benefit, if you are a person under eighteen (18) years of age.

Definition.

Affiliated Parties: These are the companies of the same group as CONFECCIÓN Y DISTRIBUCIONES FIRLÁN S.A.S. ("BABALÚ"). These general terms and conditions of "BABALÚ" apply to any personal data registration made in person, by telephone and/or virtually for affiliation to any product, service or benefit of "BABALÚ".

Customer and/or User: the person who has registered any personal data to link to any BABALÚ product, service or benefit.

Regarding your personal data

To access BABALÚ's products, services and benefits, you must voluntarily and freely provide your true, non-sensitive personal identification data, such as: name, surname, identification, age, gender, telephone number, physical and electronic address, country, city, etc. Online affiliation, registration and/or update.

For affiliation to products, services and/or benefits, through online registration and/or data update, personal information will be safeguarded by a personal password that you must freely determine, which will allow you to access them. At all times, in the registration process and/or any modification thereof, you must ensure your personal information with secure passwords with a high level of reliability and/or difficulty.   • Sending commercial or promotional information, invitations or company or third-party partner courtesies.

  • Conducting surveys and/or opinion polls on products and content.

  • Performing market segmentation, consumption analysis and preferences.

Likewise, the personal data of the customer and/or user, depending on the type of service they linked to with BABALÚ, may be used to:

  • Participate in the Interaction spaces of the "BABALÚ" website.

  • Learn or understand the effectiveness of the ads you read.

In turn, anyone who provides their personal data to BABALÚ declares that they know and accept that their data may be used to promote, direct, execute, and in general, carry out commercial or advertising campaigns, promotions, or contests by "BABALÚ" and its affiliates or subsidiaries or by other individuals or companies with whom it contracts such activities, through email, text messages (SMS and/or MMS) or through any other analogous and/or digital communication medium.

Knowledge, update and rectification of personal information

At any time, customers and/or users may request "BABALÚ", as the data controller, to provide information about their personal data, to update or rectify it. They may also include new data if they wish, delete or exclude it from the database, unless the data is absolutely necessary for the provision of the service to which the customer and/or user is registered and/or subscribed and they wish to remain in it. Otherwise, they will be completely delinked from it.

Rights of customers and/or users (Law 1581 of 2012, article 8)

  • To know, update and rectify their personal data before the Data Controllers or Data Processors.

  • To request proof of the authorization granted to the Data Controller, except when it is expressly exempted as a requirement for processing, in accordance with the provisions of Article 10 of Law 1581 of 2012.

  • To be informed by the Data Controller or Data Processor, upon request, regarding the use made of their personal data.

  • To file complaints before the Superintendence of Industry and Commerce for infringements of the provisions of this law and other norms that modify, add to or complement it.

  • To revoke the authorization and/or request the deletion of data when the processing does not respect constitutional and legal principles, rights and guarantees. The revocation and/or deletion will proceed when the Superintendence of Industry and Commerce has determined that the Data Controller or Processor has engaged in conduct contrary to this law and the Constitution.

  • To access, free of charge, their personal data that has been subject to processing.

“BABALÚ” may unilaterally change its privacy policy and personal data use policy. We will not limit your rights derived from this privacy policy and personal data use policy without your express consent. We will publish any modification to this privacy policy and personal data use policy on this page. In addition, we will keep previous versions of this privacy policy and personal data use policy.
The continued use of the services or non-disconnection from them by the customer and/or user after notification of the new privacy policy constitutes acceptance of the same.

Validity

The client and/or user accepts and acknowledges that this authorization will be valid from the moment it was accepted and for as long as BABALÚ FASHION, TARRA´O and INIZIO ACTIVE carry out the activities inherent to their corporate purpose.
